All services are customized per client, based on individual business needs and project scope.
2. Fees and Payments
Due to the bespoke nature of our services, all onboarding, strategy development, campaign management, and ongoing support fees are quoted individually per client, following an in-depth needs analysis and proposal acceptance.
Clients are responsible for their own advertising budgets, which are paid directly to the advertising platforms.
All service fees are non-refundable and payable according to the agreed billing cycle outlined in the individual service agreement.
3. Client Responsibilities
Clients agree to:
Provide timely and accurate information, assets, and approvals.Maintain an active payment method for service fees.Actively participate in strategy sessions and provide necessary internal resources to implement the solutions effectively.
4. Intellectual Property
All AI models, systems, workflows, creatives, and campaign strategies developed by Peaking Momentum remain the intellectual property of Peaking Momentum unless otherwise agreed in writing.
Client-owned branding, content, and data remain the exclusive property of the client.
5. Confidentiality
Both parties commit to protecting the confidentiality of proprietary information, strategies, and business processes shared throughout the engagement.
6. Results Disclaimer
While we leverage industry-leading technology, AI systems, and best-in-class marketing strategies, Peaking Momentum makes no guarantees regarding specific outcomes, ROI, or lead conversion rates, as these are influenced by market conditions and variables beyond our control.
7. Limitation of Liability
Peaking Momentum will not be held liable for any direct, indirect, incidental, consequential, or special damages resulting from the use of our services, including but not limited to:
Platform-related issues, outages, or account bans.External market conditions impacting performance.Client misuse of provided tools, strategies, or workflows.
8. Termination
Service engagements may be terminated by either party with
30 days written notice
